Rental Agreement - Terms & Conditions
Please review the terms and conditions relating to this reservation.
Renter must be at least 35 years of age to Reserve and Check-in unless a married couple with children.
Deposits & Payments
We accept VISA, MASTERCARD, DISCOVER, and AMERICAN EXPRESS.
For reservations made more than 60 days prior to arrival, one half of your lodging is due upon booking. The other half is due 60 days prior to arrival. Payments will be charged automatically to your credit card when due.
For reservations made less than 60 days prior to arrival, your rental fee, including lodging, taxes, a Rental Damage Protection fee, and a departure cleaning fee, is due in full immediately upon confirmation.
We are reserving the property for you with the following terms and conditions:
You agree to pay the total amount due, including rents and other fees, in advance to Monarch Luxury Villas and to comply with all terms of this agreement.
You must sign and return this rental agreement within 48 hours of receipt or we cannot guarantee the reservation.
Rental Damage Protection Policy
Monarch Luxury Villas requires a Rental Damage Protection Policy (insurance). This policy covers unintentional damages to the rental unit that occur during your stay, provided they are disclosed to management prior to check-out. The policy will pay a maximum benefit of $5000.00.
Full details of the policy are contained in the Rental Damage Protection Policy Certificate that will be emailed to you upon completion of your reservation.
Please note that the Rental Damage Protection Policy does not cover intentional damage, negligence, or willful and/or malicious damage to the unit. The protection policy may not be used to cover damages caused by a pet. Renter hereby authorizes Monarch Luxury Villas to charge the credit card on file for the cost of repairs, replacement, services, or extra cleaning for all damage, breakage and/or loss incurred during his/her stay that exceed the $5000 amount, or for any damages that are willful, negligent, or malicious in nature. Documentation detailing damages and charges will be provided to the guest in such an event.
Cancellations & Refunds
If you cancel your reservation more than 60 days prior to your arrival date, 75% of your lodging, taxes, and departure cleaning fee will be returned to you. Your Rental Damage Protection Policy and trip insurance (if purchased) are nonrefundable.
If you find you have to cancel your reservation less than 60 days prior to your arrival date, all lodging fees will be refunded if, and only if, the unit can be re-rented. If re-rented, all monies, less cancellation fee will be refunded. The Rental Damage Protection Policy, and trip insurance (if purchased) is not refundable.
All notice of cancellation must be communicated via email and confirmed over the telephone.
Should the owner of any property elect to remove their property from our rental program, Renter agrees not to hold Vacation Rentals by Jenn liable. In such an instance, Renter and/or Guests will be relocated to accommodations deemed to be comparable by the rental agency. If comparable accommodations are not available, the Renter will receive a full refund.
Check-In / Checkout
A guest information sheet detailing directions, access to the unit, and property information will be emailed to you prior to arrival. It is your responsibility to review, and if so desired, seek clarification on property specific questions prior to your arrival.
Check-in is after 4:00 PM. Checkout is at 10:00 AM.
Unless you have specifically arranged for an early arrival time, please do not arrive at the property before your scheduled check-in time. Additionally, your prompt departure is appreciated so we can prepare the unit for any incoming guests. Renter and all Guests must vacate the property and return all keys to the lockbox no later than 10:00 AM. Failure to check out on time will result in a $200 late checkout fee. A $50 fee will be assessed for any lost or stolen keys. All units are cleaned and inspected upon your departure.
For rental purposes, each property is fully equipped with a television(s), linens, dishes and utensils and a starter supply of soap, cleaning, and paper goods. Other amenities vary from property to property and are mostly listed in the property details on our website and in the property's guest information packet. You will need to bring or purchase additional supplies for your own personal wants or needs. We cannot accept responsibility for any aesthetic conflicts. Monarch Luxury Villas reserves the right to change units for any reason.
Any maintenance problems will be handled in a timely and professional manner. No credits or refunds will be issued as a result of the malfunction of any equipment or appliances, including TV’s, DVD’s, air conditioning units, hot water heaters, stoves, refrigerators, door locks, etc.
Each property has a specific maximum occupancy. Take note of the maximum number of guests allowed in the unit before making your reservation. This policy is strictly enforced.
Our properties are located in residential areas and are rented for personal vacation use only. Parties, weddings, and other large gatherings are not allowed. Monarch Luxury Villas reserves the right to cancel or rescind any rental agreement if it is found that the Renters and/or Guests are conducting unlawful activities, disturbing others by playing loud music, causing any loud or offensive noises, have made any misrepresentations about the nature or size of the group or the use of the property, or for any other misrepresentations that are in any way in breach of the rental agreement. Violators risk forfeiture of their deposit, rental fees, and eviction.
All units are Non-Smoking! No exceptions - the minimum fine is $500.
No pets allowed unless pre-arranged with the management company. Not all units accept pets. There is an additional pet fee of $150 per pet per reservation. Renters are responsible for their pet(s) at all times and must ensure all solid wastes have been picked up and disposed of prior to departure. There will be a $500 fine if there is an unauthorized pet on the property.
A non-refundable cleaning fee is required for all reservations. This fee is for our housekeepers who dust, vacuum, sanitize, clean linens and towels, maintain the hot tub (if so equipped), and remove refuse from the property. Renter agrees to maintain the cleanliness of the premises during occupancy and to leave the premises reasonably clean and in good condition upon departure. Undue and/or unreasonable cleaning of the property shall be charged to the Renter's/Cardholder's credit card as an Additional Cleaning Charge at a rate of up to $75/hour with a one-hour minimum. This also applies to the property's exterior, general grounds, garages, outbuildings, equipment (BBQ's, etc.), and hot tubs (if so equipped).
Any representative of Monarch Luxury Villas, as Agent, may enter the premises at any time in the event of an emergency. However, we will always try to provide at least 24 hours notice for normal maintenance or inspections.
Monarch Luxury Villas, LLC is not responsible for events beyond our control, e.g. sickness, inclement weather, or maintenance issues. Optional travel insurance is available from Rental Guardian through Monarch Luxury Villas and covers cancellation or interruption of your stay, travel delay, baggage delay, rental car damage, and emergency/medical/dental expenses. If purchased, please read your documentation carefully as certain limitations, restrictions, and exclusions apply. The plan is optional, however we strongly recommend it. In the event unanticipated circumstances arise, having this coverage helps considerably in protecting your vacation investment. Please ask your reservation specialist for additional information.
Catastrophic Events & Emergency Evacuations
If a catastrophe (fire, snowstorm, flood, etc.) or any situation beyond our control impairs or impedes the viability of the vacation rental, Monarch Luxury Villas is not responsible for finding alternate lodging for the renter or for the renter's financial losses related to transportation or alternate lodging. There will be no refunds or credits in the event of extreme weather or natural disaster. Therefore, again, we strongly suggest you consider travel insurance to secure your vacation investment and eliminate your financial risk.
The Renter agrees that Monarch Luxury Villas shall not be liable to Renter, Renter’s guests, invitees or any other person for any injury, loss or damage to any person or property on or about the rental premises. Renter shall hold Monarch Luxury Villas harmless and indemnified from and against all loss or damage occasioned by use, misuses or abuse of any part of or fixture on the premises, surrounding areas and from or against any omission, neglect, or default of the Renter, his/her guests or invitees. The Renter acknowledges that Monarch Luxury Villas acting solely in the capacity of Agent for the property owner assumes no liability thereunder.
Limitations of Liability
Some activities in which guests engage are especially dangerous and include skiing, snowboarding, mountain biking, boating, golfing, hiking, and mountain climbing. This list is not all-inclusive, but indicates some of the hazards of vacationing in California. Guests may also encounter the following risks: slippery floors and stairs (especially when wet), precipitous drop-offs, unfenced Jacuzzis, gas BBQ grills, clean/clear sliding glass doors, and dangerous stairs or pathways. Therefore, each guest agrees that he/she is voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property.
By booking this unit, you acknowledge that in all events and circumstances, Monarch Luxury Villas, its officers, and employees shall not be held liable.
